Please read these Terms carefully. They're an agreement between you and Guest Holdings LLC, doing business as Altus Labs ("Ascend," "we," "us," "our"), covering your use of the Ascend app. By downloading or using Ascend, you agree to them. If you don't agree, please don't use the app.
You must be at least 18 years old to use Ascend. By using it, you confirm that you are.
Ascend gives you AI-generated appearance analysis, hairstyle suggestions, and coaching, based on photos you submit.
Ascend is for information and self-improvement only. It is not professional advice. Nothing in the app is medical, dermatological, psychological, or cosmetic advice. Scores, analyses, suggestions, and coach replies are generated by AI and can be wrong, incomplete, or not right for you, and they will vary between scans. Don't rely on Ascend to make health, medical, or cosmetic-procedure decisions — talk to a qualified professional first. If you're struggling with how you feel about your appearance or your mental health, please reach out to a professional.
Some features need a paid subscription, sold through the Apple App Store and billed to your Apple ID.
You own the photos and content you submit. You give us a limited, non-exclusive license to use, process, and store them only to provide Ascend's features to you — for example, to generate and show your analysis and previews. This license ends when the content is deleted in the normal course of our operations or at your request. It does not let us use your photos for advertising or to train AI models. See our Privacy Policy for how long we keep things.
When you submit photos, you confirm that:
Don't upload photos of other people without their consent, don't upload anything involving minors, and don't use Ascend to harass or analyze others without permission. Don't reverse-engineer, scrape, or misuse the app or its APIs, interfere with its operation or security, or try to get around usage limits or paywalls.
We may add, change, or remove features, and we may update these Terms. If we make material changes to the Terms, we'll update the date above and, when it matters, let you know in the app. Continuing to use Ascend after a change means you accept it.
You can stop using Ascend anytime and delete your data from the app. We may suspend or end your access if you break these Terms or to protect the app or other users. Sections that should outlast your use — disclaimers, liability limits, and dispute resolution — continue to apply.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY RESULT WILL BE ACCURATE OR RELIABLE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUEST HOLDINGS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WON'T EXCEED THE GREATER OF WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 50. Some places don't allow certain limitations, so some of the above may not apply to you.
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law rules.
Please read this part carefully — it affects your legal rights.
Binding arbitration. Except for the exceptions below, you and Guest Holdings LLC agree that any dispute arising out of or relating to these Terms or the app will be resolved by final and binding arbitration on an individual basis, not in court. Arbitration will be run by a recognized arbitration provider under its consumer rules, in English, and may take place in King County, Washington, by phone or video, or in the US county where you live.
Class-action waiver. You and we agree to bring claims against each other only as individuals, not as part of any class or representative proceeding.
Exceptions. Either of us may bring an individual claim in small-claims court if it qualifies, or seek an injunction in court to protect intellectual-property rights. Any dispute not subject to arbitration will be handled by the state or federal courts in King County, Washington, and you consent to their jurisdiction.
Opt-out. You can opt out of this arbitration agreement by emailing ascend@altuslabs.app within 30 days of first accepting these Terms. Opting out doesn't affect the rest of these Terms.
Nothing here takes away a right to bring a claim in your local courts where the law gives you that right and doesn't allow it to be waived.
These Terms are between you and Guest Holdings LLC, not Apple. Apple isn't responsible for the app or its content and has no obligation to support it. Apple is a third-party beneficiary of these Terms and may enforce them.
